The eHealth Saskatchewan Citizen Health Information Portal ("Citizen Health Information Portal") is designed to empower patients to better manage their healthcare by providing online access to their personal health information.

These Citizen Health Information Portal Terms and Conditions (the "Citizen Health Information Portal Terms of Use") govern your access to and use of Citizen Health Information Portal.

Please read these Citizen Health Information Portal Terms of Use carefully. They are a legal agreement between you and eHealth. By using Citizen Health Information Portal, or by clicking the acceptance button, you agree to be bound by these Citizen Health Information Portal Terms of Use, including all amendments made from time to time. If you do not agree to these Citizen Health Information Portal Terms of Use, do not use Citizen Health Information Portal.

Citizen Health Information Portal is not intended to provide you with any medical advice or any other advice. There is no substitution for professional medical advice from your healthcare professional or other licensed medical professional.

For advice about your test results or your medical condition, ask your healthcare professional.

Medical information, including test results, will be presented to you in Citizen Health Information Portal in substantially the same format in which it is presented to your physician or other health care provider(s). eHealth has not taken any steps to adapt the presentation of the information to make it more understandable to individuals without medical training. Please always discuss the information with a medical professional to ensure you interpret the information correctly. If you do not discuss your medical information with your healthcare professional it is possible that you might misunderstand the implications of your medical information.

Never change or stop any course of treatment without first consulting your healthcare professional.

Any other health and health-related information contained within Citizen Health Information Portal or eHealth's website is intended to be general in nature and should not be used as a substitute for a visit to your physician or other health care provider. Any such information that you obtain from Citizen Health Information Portal or eHealth's website might be inappropriate for your own situation or might be misinterpreted. eHealth assumes no responsibility for how you use the information you obtain from this website.

Citizen Health Information Portal is provided on an 'as is' basis without representations, warranties or conditions of any kind. You agree that your use of Citizen Health Information Portal is at your sole risk. You agree that eHealth assumes no liability if Citizen Health Information Portal is unavailable at any time, or for the reliability, validity, accuracy, completeness, integrity, quality or timeliness of, or any failure to deliver or store, Citizen Health Information Portal or any medical information or other content.

  1. Use of Citizen Health Information Portal

You may use Citizen Health Information Portal for your personal, non-commercial purposes. You may not use Citizen Health Information Portal for any other purpose. You are not permitted to make any commercial or derivative use of Citizen Health Information Portal, or to use any data mining, robots, or similar data gathering and extraction methods with respect to Citizen Health Information Portal or the medical information or other content contained therein.

  1. Entering Information to Citizen Health Information Portal

The following information will be available through the Citizen Health Information Portal:


Please note that the Viewed Information is not a complete list of your lab test results, immunizations, prescriptions or clinical visits. Some information is not yet available electronically to eHealth and in some cases there are delays before the information is available electronically to eHealth.

The eHealth Citizen Health Information Portal also allows you to enter your own personal health information (the "Input Information") and is highly customizable to allow you to track and monitor your health. You are responsible for all information entered by you and all your choices on the how the information is used and displayed within the system.

eHealth does not verify, check or monitor the Input Information or how you are using or displaying the information within the system.

You will be able to amend Input Information, but will not be able to amend or change the Viewed Information. If you note an error, please contact us at the address below.

  1. Medical Information and Other Content

eHealth does not create and has no responsibility for the medical information and other content that may be available through your use of Citizen Health Information Portal. Citizen Health Information Portal is simply a tool to provide you with access to medical information and other content created by third party medical service providers and systems.

Further, the medical information contained within the Citizen Health Information Portal is not guaranteed to be complete or up-to-date. In many instances, additional information is available elsewhere.

Please review the notations provided with the information. The notations include important guidelines that will assist you in understanding the information presented.

You agree that eHealth is not liable in any way for the validity, accuracy, completeness, integrity, quality and timeliness of any medical information or other content available through Citizen Health Information Portal, and that your use or non-use of, and your reliance or non-reliance on, any such medical information or other content is at your own risk.

  1. Proxy Access

The eHealth Citizen Health Information Portal allows you to authorize others (your Proxy) to access your personal health information in the Citizen Health Information Portal. When setting up your Proxy's access, the system allows you to control the type and scope of access. If you wish, your Proxy can have the same access and privileges that you have to your Citizen Health Information Portal information.

You are responsible for all action taken by your Proxy and understand your Proxy will have access to your personal health information. Your Proxy will have access to your Citizen Health Information Portal information until you revoke access through the system. You are responsible to manage access by your Proxy to your information. You agree and understand that once accessed by your Proxy, the information may be shared by your Proxy and no longer protected by privacy law.

  1. Registration Information, User IDs and Passwords

You are entirely responsible for all usage or activity on Citizen Health Information Portal by users using your ID or password, including but not limited to use of your password by any third party. eHealth will not be responsible for any unauthorized use of your user ID or password.

  1. Termination of Access to Citizen Health Information Portal

eHealth may, in its sole discretion, terminate or suspend your access to all or any part of Citizen Health Information Portal at any time, with or without notice, for any reason, including, without limitation, breach of these Citizen Health Information Portal Terms of Use. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or activity that may otherwise affect the enjoyment of Citizen Health Information Portal or access to Citizen Health Information Portal by others, may be grounds for termination of your access to all or part of Citizen Health Information Portal at the sole discretion of eHealth.

Termination of your Citizen Health Information Portal access includes deletion of your user ID, password and all related registration information and files associated with or inside your account or user profile.

  1. Right to Change Your Viewed Information in the Citizen Health Information Portal

The information available in the Citizen Health Information Portal is personal health information as defined in The Health Information Protection Act (HIPA), and you have the right to access and amend your information as set out in HIPA.   1. Relationship with TELUS

The eHealth Citizen Health Information Portal is being provided by eHealth with the support of TELUS Health Solutions Inc. (TELUS).

For the pilot of the Citizen Health Information Portal, your Proxy will access your Citizen Health Information Portal information through the TELUS Health Vault and may see the TELUS Terms and Conditions and Privacy Policy at the bottom of the screen.   1. Intellectual Property Rights

eHealth owns copyright in the content made available through Citizen Health Information Portal, including text, images and source code, and trade-mark rights in material used as trade-marks, including text, logos and icons. Except as otherwise provided herein, nothing in these Citizen Health Information Portal Terms of Use vest or transfer any intellectual property rights in or to you and any use, alteration, or replication of any of eHealth's intellectual property is a violation of these Citizen Health Information Portal Terms of Use and applicable Canadian and international intellectual property laws.

You agree to not take any action to jeopardize, limit or interfere with eHealth's intellectual property rights, including making copies of copyright protected material and using or challenging eHealth's trade-marks.

Certain materials or information available to you through the Citizen Health Information Portal or through links to third party websites may be subject to third party intellectual property rights. All such intellectual property rights are and shall remain the property of their respective owners or creators (as the case may be). You acknowledge and agree that eHealth is not responsible for the accuracy, completeness or content provided by or on behalf of third parties.

All other trademarks, service marks and logos used in this site are the trademarks, service marks, or logos of their respective owners. Nothing on eHealth's website should be construed as granting any license or right to use any trademark, service mark, or logo displayed on the website without the express written permission of eHealth or the third party that may own the trademark, service mark, or logo.

Links from or to internet sites outside the Citizen Health Information Portal are meant for convenience only and your access to them is at your own risk. The publishers of the outside sites manage their content, which is not reviewed or approved by eHealth. These links are not endorsements, guarantees or recommendations by eHealth of the products or services offered on those sites. eHealth cannot guarantee that these links are functional or secure and cannot be held responsible for damages or prejudice of any nature resulting from the use or the content of the other sites connected to the Citizen Health Information Portal through links.

  1. Privacy and Confidentiality

By agreeing to these Citizen Health Information Portal Terms of Use, you are also agreeing to eHealth's Citizen Health Information Portal Privacy Policy. The Privacy Policy should be reviewed prior to accessing and using Citizen Health Information Portal.

  1. Representations and Warranties

eHealth makes no representations, warranties or covenants to any person or entity with respect to Citizen Health Information Portal. eHealth does not give any warranties, guarantees, representations or conditions, whether express, implied, statutory or otherwise (including, without limitation, any warranty as to the accuracy, completeness, currency, or suitability of the information delivered as part of the Citizen Health Information Portal, third party information, materials or website content, fitness for a particular purpose, compliance with any description, or non-infringement of third party rights) with respect to the Citizen Health Information Portal and all such warranties are hereby disclaimed to the maximum extent permitted by applicable law.

eHealth does not guarantee that Citizen Health Information Portal will be provided or available without interruption or error free. Citizen Health Information Portal is delivered through third-party network services providers and you understand that there may be service disruptions or outages.

  1. Limitation of Liability and Indemnity

To the maximum extent permitted by applicable law, eHealth, its agents, assigns, employees, contractors, consultants, and service providers and their respective successors and assigns shall not be liable to you or any third party for any direct (except as otherwise set out below), indirect, special, incidental, punitive, or consequential damages whatsoever incurred through the use of Citizen Health Information Portal. eHealth is not responsible for any use of Citizen Health Information Portal by you or any third party, loss of profit, loss of revenue, loss of reputation, or for any business interruption arising out of or in any way related to these Citizen Health Information Portal Terms of Use, your use of, or inability to use, Citizen Health Information Portal. eHealth is not responsible for any information, website content or materials made available by or on behalf of third parties whether referenced in the Citizen Health Information Portal or otherwise accessible over the internet.

The aggregate liability of eHealth in connection with these Citizen Health Information Portal Terms of Use, your use of the Citizen Health Information Portal or any other circumstance giving rise to liability shall be limited to direct damages arising out of the bad faith, willful misconduct or gross negligence of eHealth.

You agree to defend, indemnify, and hold harmless eHealth, its agents, assigns, employees, contractors, consultants, and service providers and their respective successors and assigns, from and against any and all claims, demands, actions, proceedings, liabilities, judgments, penalties whether civil or criminal, taxes, and all costs, liabilities and expenses (including, without limitation, reasonable legal fees on a solicitor client basis) arising out of or relating to your use of Citizen Health Information Portal, or that may be incurred by eHealth arising out of, or relating to, your violation of these Citizen Health Information Portal Terms of Use, the misuse or illegal use of Citizen Health Information Portal, or any violation by you of applicable law or rights of any third parties (including intellectual property rights), the failure of you to comply with applicable laws and regulations, any errors in any data (including maintenance data) supplied to eHealth, or your gross negligence or wilful misconduct.

  1. Governing Law and Jurisdiction

These Citizen Health Information Portal Terms of Use and any transactions contemplated by these Citizen Health Information Portal Terms of Use shall, in all respects, be construed according to, and the rights and liabilities of the parties shall in all respects be governed exclusively by, the laws of the Province of Saskatchewan without reference to the rules of conflicts of law. Any dispute between you and eHealth regarding these Citizen Health Information Portal Terms of Use shall be determined by final and binding arbitration in Saskatchewan, on a simplified and expedited basis by one arbitrator pursuant to the current laws and rules relating to commercial arbitration in Saskatchewan on the date of the notice of arbitration. For greater certainty, you agree to waive any right you have may have to commence or participate in any class action against eHealth and, where applicable, you also agree to opt out of any class proceedings against eHealth.

  1. Monitoring

Please note that eHealth employees reserve the right to monitor and review all communications and data available through Citizen Health Information Portal for the purposes of managing Citizen Health Information Portal, investigating incidents, and adding functionality. By accessing the Citizen Health Information Portal, you are expressly consenting to these monitoring activities.

  1. Changes to the Citizen Health Portal Terms of Use

eHealth may modify these Citizen Health Information Portal Terms of Use from time to time. If you do not agree to any modifications, you should stop your use of Citizen Health Information Portal. Your continued use of Citizen Health Information Portal now, or following the posting of notice of any changes in these Citizen Health Information Portal Terms of Use, will constitute a binding acceptance by you of these Citizen Health Information Portal Terms of Use, and any subsequent modifications.
